Title IX
Title IX is a federal civil rights law that prohibits discrimination on the basis of sex in federally funded education programs and activities. Specifically, the guidance states that, “Title IX’s sex discrimination prohibition extends to claims of discrimination based on gender identity or failure to conform to stereotypical notions of masculinity or femininity and OCR accepts such complaints for investigation."
At UAB, we are committed to providing recognition, prevention and effective responses to sexual orientation discrimination and harassment. We are committed to fostering a learning and working environment, where all are treated equitably and with tolerance and respect.
Title IX provides that “[n]o person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”
The Dear Colleague Letter warns that there is a violation of Title IX and OCR regulations when student peer-on-peer harassment based on sex is sufficiently serious that it creates a hostile environment, “and such harassment is encouraged, tolerated, not adequately addressed, or ignored by university employees.”
Though Title IX does not prohibit discrimination on the basis of perceived orientation, in some cases, harassment based on gender identity or orientation (even perceived orientation) may occur “because of” sex and, therefore, be sexual harassment of the type proscribed by Title IX.
